Terms & Conditions — Fluent CW

These Terms govern your use of the mobile application Fluent CW (the "App"), published by Deep Sea Developers ("we", "us", "our"). By downloading or using the App you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, worldwide, non-exclusive, non-transferable, revocable license to download and use the App on a compatible device that you own or control, solely for your personal, non-commercial use. This license is subject to these Terms and to the Google Play Terms of Service (https://play.google.com/about/play-terms/).

All rights not expressly granted are reserved.

2. Ownership

The App, including all code, graphics, audio, and text, is owned by Deep Sea Developers or its licensors. The App is licensed to you, not sold. Nothing in these Terms transfers any intellectual-property rights to you.

International Morse code itself is a public standard and is not claimed as our property.

3. Restrictions

You must not:

Reverse-engineer, decompile, or disassemble the App, except to the limited extent permitted by applicable law.
Modify, adapt, or create derivative works of the App.
Distribute, sublicense, lease, sell, or rent the App or any portion of it.
Remove, obscure, or alter any proprietary notices in the App.
Tamper with the App's stored data or the progress-import feature in order to obtain paid content without purchasing it.
Use the App for any unlawful purpose or in violation of these Terms or any applicable law.

4. In-App Purchases

The App offers a single one-time, non-consumable in-app purchase that unlocks the full course. There is no subscription. All purchases are processed by Google Play under Google's terms. We do not handle or store your payment details.

By making a purchase you acknowledge and agree that:

All purchases are final and non-refundable except as required by applicable law or by Google Play's refund policy (https://support.google.com/googleplay/answer/2479637).
The unlock is tied to the Google Account that made the purchase. It can be restored on reinstall or on another device via the Restore a previous purchase button.
The free portion of the App remains usable without any purchase.

5. Your Training Data

Your Koch level, practice history, and settings are stored only on your device. We hold no copy and operate no backup service. If you uninstall the App, clear its storage, reset your progress, or lose your device, that data is gone and we cannot restore it.

The App provides an export feature so you can keep your own copy. Keeping a backup is your responsibility.

6. Not a Licensing or Examination Service

The App is a practice tool for Morse code (CW). It is not affiliated with, endorsed by, or a substitute for any amateur radio licensing authority, examination body, club, or training organisation. Progress within the App confers no qualification, certification, or operating privilege of any kind.

You are solely responsible for holding any licence required to transmit in your jurisdiction.

7. Updates and Availability

We may modify, update, suspend, or discontinue the App or any feature at any time, with or without notice. We do not guarantee that the App will always be available or compatible with future devices or operating-system versions.

8. Disclaimer of Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that it will produce any particular improvement in your Morse proficiency.

The App produces audio tones. You are responsible for setting a safe listening volume, particularly when using headphones.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEEP SEA DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

Our total aggregate liability for any claim relating to the App shall not exceed the amount you actually paid for the App and its in-app purchase in the twelve months preceding the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless Deep Sea Developers from any claim or demand, including reasonable legal fees, arising out of your misuse of the App or your violation of these Terms or of any applicable law.

11. Termination

This license terminates automatically if you breach these Terms. You may terminate at any time by uninstalling the App. Sections 2, 8, 9, 10, 13, and 16 survive termination.

12. Changes to These Terms

We may revise these Terms from time to time. Material changes will be reflected by updating the "Effective date" above. Continued use of the App after changes indicates acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts of Pakistan, except where applicable consumer-protection law in your country of residence grants you the right to bring proceedings locally.

14. Third-Party Services

The App uses Google Play Billing for in-app purchases, and Firebase Analytics and Crashlytics (Google) for anonymous usage statistics and crash reports. Your use of those services is governed by Google's terms and privacy policy. We are not responsible for third-party services or their availability. See our Privacy Policy for what those services collect.

15. Severability

If any provision of these Terms is held unenforceable, that provision shall be limited or removed to the minimum extent necessary, and the remaining provisions shall remain in full force.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Deep Sea Developers regarding the App, superseding any prior agreements.
